MedicLog Terms of Use
Version 1.0 — January 2026
1. Beta Software Notice
MedicLog is beta software under active development. While we implement security best practices including encryption, access controls, and PHI warnings, this software is provided for evaluation purposes.
THIS APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
We implement:
- Device encryption (iOS Data Protection)
- Encrypted transmission (AirDrop, secure channels)
- PHI warnings at export points
- Local-only storage (no cloud transmission)
However, YOU remain solely responsible for HIPAA compliance.
2. Your Responsibility for HIPAA Compliance
YOU (the user) are solely responsible for:
- Ensuring your use complies with HIPAA and applicable laws
- Following your organization's policies and procedures
- Properly handling Protected Health Information (PHI)
- Using device security (passcode, Face ID, encryption)
- Sharing data only with authorized personnel
- Maintaining patient confidentiality
The developer is NOT a Business Associate under HIPAA. We do not access, transmit, or store your patient data. All data remains on YOUR device.
3. Medical Disclaimer
This app is a documentation tool, NOT medical advice.
Always follow your training, protocols, and medical direction.
The developer is NOT LIABLE for:
- Clinical decisions made using this app
- Errors or omissions in documentation
- Medication dosing or treatment decisions
- Patient outcomes or adverse events
Clinical Tools and Protocol References
MedicLog may present clinical tools, assessment scales, protocol references, or third-party app integrations based on user selections. All such tools are presented in response to choices made by the licensed clinician. MedicLog does not diagnose, recommend treatment, or direct patient care. All clinical decisions remain the sole responsibility of the licensed clinician using the app in accordance with their training, scope of practice, and applicable medical protocols.
4. Data Storage and Security
- All data stored locally on YOUR device only
- YOU are responsible for device security
- Enable device passcode/biometrics (Settings → Face ID & Passcode)
- Device backups (iCloud/iTunes) may contain PHI — secure appropriately
- No cloud sync — developer cannot access your data
5. Sharing and Exports
When sharing call logs via AirDrop, email, or other methods:
YOU are responsible for:
- Verifying recipient is authorized to receive PHI
- Using secure transmission methods when available
- Following HIPAA minimum necessary standard
- Documenting disclosures per your organization's requirements
Inter-agency handoffs (fire→ambulance) include patient information. This is STANDARD EMS PRACTICE and medically necessary for continuity of care. MedicLog provides BETTER security than paper handoffs.
6. Agency/Organizational Use
If using MedicLog as part of an organization:
- Obtain approval from your supervisor/compliance officer
- Follow organizational policies for documentation
- Report security incidents per your policies
- Understand EMS documentation requirements in your jurisdiction
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:
- HIPAA violations or regulatory penalties
- Loss, corruption, or unauthorized access to data
- Clinical errors or patient harm
- Any damages arising from use or inability to use this app
8. Indemnification
You agree to indemnify and hold harmless the developer from any claims, damages, or expenses arising from:
- Your use of this app
- Your violation of these terms
- Your violation of HIPAA or other regulations
- Clinical decisions or patient care activities
9. Changes to Terms
These terms may be updated for new versions. Major changes will require re-acceptance. Continued use constitutes acceptance of updated terms.
Acknowledgment
By tapping "I Accept" in the MedicLog app, you acknowledge that:
- You have read and understand these terms
- You accept full responsibility for HIPAA compliance
- You will use this app according to your training and protocols
- You will follow your organization's policies
- You understand this is beta software without warranty
- You accept all risks associated with using this app
If you do not accept these terms, do not use this app.
